Private prison contractors must demonstrate the ability to provide incarceration services resulting in an offender recidivism rate at least 10% lower than the Mississippi Department of Corrections' recidivism rate, effective July 1, 2020.

Recidivism is defined as conviction of a new felony offense within 3 years of release from prison.

The Mississippi Department of Corrections must collect and report recidivism rates by offense type, risk level, and individual correctional facility.

The Department must submit semiannual reports on all collected data to the Oversight Task Force, Lieutenant Governor, Speaker of the House, and Judiciary committee chairs.

Private incarceration contracts must still demonstrate at least 10% cost savings compared to Department of Corrections operations.
