Peace officers shall not take a person into custody based solely on an alcohol-related offense if the person requested emergency medical assistance in good faith for someone appearing to need medical help due to alcohol consumption and did not illegally provide the alcohol.

The person requesting assistance must provide their full name and relevant information to the officer, remain at the scene until emergency medical services arrive, and cooperate with emergency personnel and officers.

Persons meeting these criteria are granted immunity from criminal prosecution for any offense related solely to possession and consumption of alcohol.

Persons cannot initiate or maintain legal action against peace officers or their employing agencies based on the officer's compliance or non-compliance with these provisions.
