Expands the definition of "active site" for underground storage tanks to include tanks currently in service, temporarily closed, and temporarily out of service.

Increases the annual tank regulatory fee cap from $100 to $200 per tank per year, with the commission setting the fee amount after receiving recommendations from the Underground Storage Tank Advisory Council and allowing at least 30 days for public comment.

Creates a five-member Underground Storage Tank Advisory Council to conduct independent cost studies, annually review program costs, and recommend equitable fee systems based on tank types and quantities.

Requires the Underground Storage Tank Advisory Council to submit annual reports by January 1 each year to the commission and department executive director regarding program needs and fee adequacy.

Takes effect July 1, 2018, with initial council appointments required by January 1, 2018.
