Prohibits any person from intentionally performing or attempting to perform an abortion when the pregnant woman is seeking the abortion solely because of a prenatal diagnosis indicating Down syndrome or potential Down syndrome in the unborn child.

Establishes criminal penalties of a fine up to $25,000, imprisonment up to two years in the State Penitentiary, or both, for any physician or other person who performs or attempts to perform a prohibited abortion.

Requires attending physicians to complete individual abortion reports certifying they have no knowledge that the woman sought the abortion solely due to a Down syndrome prenatal diagnosis or potential.

Includes a severability clause stating that if the prohibition is invalidated for pre-viability pregnancies, it shall remain applicable to pregnancies subsequent to viability.

Takes effect July 1, 2018.
