MS SB2754

Prohibits creating, designing, manufacturing, selling, purchasing, leasing, installing, updating, repairing, servicing, transferring, using, or possessing automated sales suppression devices ("zappers") and phantom-ware that falsify electronic cash register and point-of-sale system records.

Defines "automated sales suppression device" as software that falsifies electronic records of cash registers and point-of-sale systems, including transaction data and reports, accessed via memory stick, optical disc, Internet link, or other means.

Defines "phantom-ware" as hidden programming embedded in cash registers that creates alternate transaction records or eliminates and manipulates transaction records.

Establishes violation as a felony punishable by a fine up to $100,000, imprisonment up to 15 years, or both.

Requires forfeiture of any automated sales suppression device, zapper, phantom-ware, or device containing such software to the state; effective July 1, 2018.
