Senate Bill 2866 Summary

• Amends Section 41-29-147 to clarify that a "second or subsequent" drug offense requires prior convictions "upon charges separately brought arising out of separate incidents at different times" and corrects spelling of "marijuana."

• Adds new exception to the three-year statute of limitations for post-conviction relief motions when there has been an adoption or enactment of state law that would have actually adversely affected the outcome of the conviction or sentence.

• Modifies Section 99-39-27 to allow dismissal or denial of a post-conviction application to not bar a second or successive application when new state law would have adversely affected the conviction or sentence outcome.

• Effective date: July 1, 2018.
