Amends Mississippi Code Sections 77-3-725 and 77-3-727 to create a separate private cause of action for violations of the Mississippi Telephone Solicitation Act.

Allows persons who receive illegal telephone solicitations to sue in circuit or county court in their county of residence for injunctive relief and/or monetary damages of $5,000 per violation or actual monetary loss, whichever is greater.

Provides that prevailing plaintiffs in private lawsuits shall be awarded reasonable attorney fees by the court.

Clarifies that the private right of action is in addition to existing remedies, including complaints filed with the commission and penalties under other state law.

Maintains the commission's existing authority to investigate violations, issue cease and desist orders, and assess civil penalties up to $5,000 per violation.
