HB 1371 - Mississippi Medical Marijuana Act of 2019

• Legalizes medical marijuana use by qualifying patients with qualifying medical conditions including cancer, glaucoma, HIV/AIDS, ALS, PTSD, chronic pain, seizures, and others approved by the Department of Health.

• Establishes a regulatory system with the Medical Marijuana Commission licensing 20-40 dispensaries and 4-8 cultivation facilities, with the Alcoholic Beverage Control Division overseeing operations.

• Protects qualifying patients and designated caregivers from criminal prosecution if they possess no more than 2.5 ounces of usable marijuana within a 14-day period and hold valid registry identification cards.

• Requires physicians to issue written certifications for qualifying patients and prohibits physicians from accepting payments from dispensaries or holding economic interests in facilities where they certify patients.

• Allocates state sales tax revenue from marijuana sales as follows: 5% to Department of Health, 4% to Alcoholic Beverage Control Division, 1% to Medical Marijuana Commission, and remainder to General Fund.
