The office of election commissioner is made a nonpartisan office, and candidates are prohibited from campaigning or qualifying based on party affiliation.

Political parties and affiliated committees are prohibited from fundraising for, contributing to, or publicly endorsing candidates for election commissioner, and candidates cannot accept contributions from political parties or affiliated committees.

Candidates for election commissioner must be listed alphabetically and grouped separately on ballots with clear nonpartisan identification, with no party affiliation references appearing on ballots.

Section 23-15-213 is amended to remove the requirement that candidates declare party affiliation to the board of supervisors; the amendment takes effect January 1, 2023.

The act takes effect July 1, 2019.
