Prohibits the Department of Corrections from entering into private incarceration contracts for state offenders unless all regional correctional facilities are first utilized and at maximum capacity.

Requires the restriction on private contracts to apply to specific facilities in Leflore County, Tallahatchie County, Wilkinson County, and Walnut Grove before private housing may be considered.

Amends sections 47-4-1, 47-4-11, 47-5-941, 47-5-943, 47-5-1211, and 47-5-1213 to incorporate the requirement that regional facilities must be exhausted before private contracts are authorized.

Maintains existing cost-savings requirements that private incarceration must offer at least 10% savings compared to state facility operations for the same level of service.

Takes effect July 1, 2019 and stands repealed June 30, 2019.
