Defines "single-use plastic straw" as a disposable tube made from plastic (petroleum or biologically-based polymers) used to transfer beverages, excluding straws made from paper, pasta, sugar cane, wood, or bamboo.

Defines "food establishment" as any business in Mississippi that sells or serves food directly to consumers, including restaurants, cafes, bars, grocery stores, and catering operations.

Prohibits food establishments from providing single-use plastic straws to consumers unless the consumer requests one.

First and second violations result in a notice of violation; subsequent violations are infractions punishable by a fine of $25 per day (maximum $300 annually) enforced by the State Department of Health.

Effective July 1, 2019.
