House Bill 1531 Summary

• Exempts architectural and engineering contracts for state institution of higher learning construction and renovation projects from Department of Finance and Administration oversight when the Board of Trustees of State Institutions of Higher Learning elects to self-administer the project.

• Removes contracts for construction and maintenance of higher learning institution buildings and facilities funded by self-generated funds or general obligation bonds from Public Procurement Review Board purview, provided institutions execute project agreements with the Department of Finance and Administration.

• Requires project agreements between institutions and the Department of Finance and Administration to specify responsibilities, procurement regulations, documentation requirements, fund disbursement schedules, and handling of remaining bond funds.

• Amends Section 37-101-99 to clarify that the Department of Finance and Administration supervises contracting and erection of buildings only for projects that the Board of Trustees does not self-administer.

• Effective date: July 1, 2019.
