Cities in DeSoto County seeking to annex unincorporated territory must pass an ordinance defining the territory, describing proposed improvements, and listing city services to be provided.

Before annexation, the city must publish notice once weekly for three consecutive weeks, with the first notice at least 21 days before the annexation date and the last notice no more than 7 days before.

If 20% or 2,000 qualified electors (whichever is less) in the proposed annexation area file a written petition within the notice period, an election must be held where a majority of qualified voters in the area must approve the annexation.

Either party may appeal the election results to chancery court, where the chancellor may approve or deny the annexation based on whether it is reasonable and required by public convenience and necessity; the governing authorities bear the burden of proof and must pay all attorney's fees and costs.

The chancellor's decree becomes effective after 10 days unless appealed, and must be filed with the Secretary of State; appeal costs are taxed against the losing party.
