Governor and Division of Medicaid must negotiate with Centers for Medicare and Medicaid Services (CMS) for a Section 1115 waiver to expand Medicaid coverage to adults earning up to 138% of Federal Poverty Level (FPL).

Expanded coverage will provide private market-based health plans with at least two Qualified Health Plan options available to newly eligible adults ages 19-64.

Enrollees earning 50-138% of FPL must contribute to Mississippi Healthy Living Accounts with cost-sharing capped at 2% of income (for 50-100% FPL) or 5% of income (for 100-138% FPL), with no cost-sharing required for first six months of enrollment.

Plan automatically terminates if federal contribution rate for expanded Medicaid coverage falls below 90%.

Upon successful waiver approval, Division of Medicaid shall amend state plan and implement the waiver-authorized expansion; also adds new eligibility category (28) to Mississippi Code Section 43-13-115 for waiver-eligible individuals.
