Creates new Section 25-11-126 allowing persons receiving a Public Employees' Retirement System (PERS) retirement allowance who are elected to the Legislature after retirement to continue receiving their retirement allowance while serving.

Retired legislators who choose to continue receiving retirement allowance shall receive 50% of regular session compensation and 50% of monthly office expenses, but receive full amount of all other per diem, expense allowances, and mileage.

Retired legislators receiving a retirement allowance while serving shall not be active PERS members and shall not receive any creditable service for the period of legislative service.

Alternatively, retired legislators may elect not to receive a retirement allowance while serving, in which case they become active contributing PERS members and receive creditable service; if service exceeds six months, their retirement allowance is recomputed upon retirement.

Amends Sections 25-11-105, 25-11-127, and 5-1-41 to conform with the new provisions and clarify that retired legislators receiving allowance under Section 25-11-126 are exempt from certain post-retirement employment restrictions.
