Procurement officers violating Section 31-7-13(o) are subject to penalties under that section plus Sections 31-7-55 and 31-7-57, with referral to the State Auditor and Attorney General.

Vendors violating Section 31-7-13(o) are banned from doing business with the state or any municipality for three (3) years after a first violation, and banned indefinitely after a subsequent violation.

All invitations for bids, requests for proposals, requests for qualifications, reverse auctions, and other procurement solicitations must include Section 31-7-13(o) in its entirety in bold print with font at least one size larger than the rest of the document.

The Department of Finance and Administration's duties and powers are brought forward for possible amendment, including authority over public procurement, general services, insurance, and the Bond Advisory Division.

The act takes effect upon passage.
