Prohibits deed restrictions or covenants running with land that require transferees to pay fees to declarants, other persons, or third parties in connection with future property transfers.

Voids and makes unenforceable any such prohibited deed restrictions, covenants, or liens attempting to secure rights under them.

Allows fees for property transfers in subdivisions when payable to property owners' associations managing the subdivision (with more than one platted lot) if evidenced by recorded deed restrictions or covenants.

Allows fees for property transfers when payable to 501(c)(3) nonprofit organizations or governmental entities if evidenced by recorded deed restrictions or covenants.

Takes effect July 1, 2019.
