Creates new crime of indecent assault for knowingly and intentionally touching another person without consent on breast, buttock, inner thigh, groin, genital area or anal area for sexual gratification purposes.

First or second offense is a misdemeanor punishable by up to 6 months in county jail or a fine of up to $500, or both.

Third or subsequent offense within 7 years becomes a felony punishable by up to 5 years imprisonment in the Department of Corrections and a fine of up to $5,000.

Does not prevent prosecution under existing sexual offense statutes (Section 97-5-23 or 97-3-7).

Takes effect July 1, 2019.
