Establishes new penalty structure for first and second simple possession offenses of controlled substances (other than 30 grams or less of marijuana or 10 grams or less of synthetic cannabinoids): first offense is a misdemeanor punishable by up to 6 months imprisonment or $100 fine; second offense is a misdemeanor punishable by up to 1 year imprisonment or $200 fine.

Creates enhanced penalties for third and subsequent simple possession offenses of Schedule I and II controlled substances, marijuana, synthetic cannabinoids, and Schedule III-V substances, with penalties varying by substance type and quantity.

Modifies Section 41-29-147 to impose enhanced penalties (up to twice the normal term and fine) only upon a fourth or subsequent offense, rather than a second offense.

Maintains special treatment for possession of 30 grams or less of marijuana or 10 grams or less of synthetic cannabinoids with fines ranging from $100-$1,000 and potential drug education program requirements.

Adds sentence mitigation provisions allowing courts discretion to reduce mandatory sentences for trafficking and aggravated trafficking offenses by no less than 25% under specified circumstances, effective July 1, 2019.
