Senate Bill 2714 Summary

• Renames "drug courts" to "intervention courts" and expands the State Intervention Courts Advisory Committee to oversee drug courts, mental health courts, veterans courts, and other intervention courts, with membership appointed by the Chief Justice, Corrections Commissioner, Attorney General, Public Safety Commissioner, Public Defender, Department of Human Services Director, Department of Mental Health Director, Veterans Affairs Board Director, State Auditor, and Governor.

• Converts the Rivers McGraw Mental Health Diversion Pilot Program from a pilot program to a permanent program by removing "pilot" language throughout the statute.

• Adds requirements for intervention courts to collect demographic data on applicants by race, gender, offense charged, and indigence status; authorizes medication-assisted treatment for alcohol dependency in DUI cases with two or more prior convictions; and establishes a reentry program for offenders released from incarceration to determine eligibility for intervention court participation.

• Waives all fees and costs for intervention court participation, including chemical testing and program fees, for applicants determined to be indigent.

• Repeals the pilot program provisions of the mental health diversion statutes and conforms related statutes in the code to reflect the terminology changes and program expansions.
