Removes the prohibition on nonadjudication for holders of commercial driver's licenses or commercial learning permits at the time of a first DUI offense, allowing them to be eligible for nonadjudication under the same conditions as other first-time offenders.

Maintains all other eligibility requirements for nonadjudication, including successful completion of court-ordered conditions, no prior DUI convictions, and court approval based on demonstrated justification.

Clarifies that individuals seeking expunction of a first DUI conviction must not have been holders of a commercial driver's license or commercial learning permit at the time of the offense.

Effective date is July 1, 2020.
