MS HB1339

Exempts counties designated as "growth and prosperity counties" by the Mississippi Development Authority from all health care Certificate of Need (CON) law requirements under Section 41-7-171 et seq.

Modifies multiple sections of Mississippi Code (25-41-7, 41-4-18, 41-9-11, 41-9-23, 41-9-68, 41-71-7, 41-71-19, 41-73-5, 41-75-1, 41-75-9, 41-75-25, 41-77-1, 41-77-21, 41-77-23, 41-77-25, 43-11-9, 43-11-19, and 57-117-5) to create two versions of each section—one applicable in exempt counties and one in non-exempt counties.

Brings forward Sections 57-80-5, 57-80-7, and 57-80-9 relating to growth and prosperity county eligibility criteria, which require counties to meet unemployment or poverty level thresholds and apply through the Mississippi Development Authority.

Creates conditional language throughout the bill specifying different requirements for counties with and without CON law exemptions, affecting hospital licensing, health care facility construction, and related regulatory matters.

Takes effect July 1, 2020.
