MS HB1349

Amends Mississippi Code Section 41-29-147 to revise the definition of second or subsequent drug offense for sentencing purposes.

Requires prior convictions to have resulted in separate sentences of one year or more (previously no minimum sentence requirement) to qualify as a second or subsequent offense.

Specifies that prior convictions must arise from separate incidents at different times to count toward enhancing current offense penalties.

Maintains existing penalties for second or subsequent offenders: imprisonment up to twice the standard term, fines up to twice the standard amount, or both.

Takes effect July 1, 2020.
