Municipalities may adopt an ordinance to publish notices electronically instead of or in addition to newspaper publication, subject to approval by the governing authority.

Electronic notices must be posted on the municipality's website no later than the required publication deadline and maintained for at least one year in searchable format.

The municipality must publish instructions on accessing electronic notices at least once monthly for six months in a newspaper with general circulation in the jurisdiction.

Electronic notices must be filed in a separate notice book maintained by the municipal clerk, indexed for public inspection, and mailed or emailed to anyone who requests notices in writing.

The ordinance cannot supersede requirements for direct mail notice to specific persons or property posting requirements under existing state or local law.

Effective date: July 1, 2020.
