HB 1448 Summary

• Raises the minimum legal age to purchase tobacco products from 18 to 21 years old, effective July 1, 2020.

• Expands the definition of "tobacco" to include electronic cigarettes, alternative nicotine products, and all components and accessories thereof.

• Requires independent third-party age verification for all Internet and remote sales of tobacco products.

• Increases penalties for selling tobacco to minors: first violation $200 (up from $50), second violation $400 (up from $75), subsequent violations $1,000 (up from $150).

• Mandates permit revocation or suspension for three or more violations within three years; retailers cannot reapply for six months and no other retailer may operate at that location for six months.
