House Bill 1457 - Motor Carrier Regulation Summary

• Makes public hearings discretionary (rather than mandatory) for the Mississippi Transportation Commission when reviewing applications for certificates of public convenience and necessity and permits for motor carriers.

• Establishes strict liability for all carriers of household goods (both common and contract carriers) for loss or damage to goods they transport.

• Repeals eight code sections that previously required common carriers of passengers to file tariffs with the commission, prohibited rate changes without 30 days' notice, and authorized the commission to investigate and regulate passenger transportation rates and charges.

• Repeals three code sections that previously required contract carriers transporting passengers to file minimum charges with the commission and authorized the commission to regulate and suspend those charges for up to 180 days.

• Takes effect July 1, 2020.
