MS HB41

Removes end-stage renal disease (ESRD) facilities, including freestanding hemodialysis units, from the definition of "health care facility" under Mississippi's Certificate of Need (CON) law.

ESRD facilities will no longer be subject to CON requirements and approval processes that apply to other regulated health care facilities.

Deletes the specific definition of "End-stage renal disease (ESRD) facilities" from Section 41-7-173 of the Mississippi Code of 1972.

Effective date is July 1, 2020.
