Manufacturers of all-terrain vehicles must file annual reports with the Department of Revenue by March 1 listing all warranties issued for new ATVs sold to Mississippi residents by out-of-state retailers during the preceding calendar year.

Required report information includes vehicle identification number, make, model, model year, and purchaser name and address for each warranty.

Department of Revenue shall use warranty information to investigate and collect unpaid use taxes on all-terrain vehicles described in the reports.

Manufacturers failing to file required reports or file incomplete reports face penalties of $25 per failure to file plus $25 for each warranty not listed, in addition to other applicable penalties.

Effective July 1, 2020; information in filed reports is confidential and commissioners may compel witness testimony and production of records regarding manufacturer reporting compliance.
