MS SB2085

Amends Mississippi Code sections 23-15-839 and 23-15-857 to impose a $1,000 civil penalty on county or municipal elected officials who resign for reasons other than illness, incapacity, or death of an immediate family member.

Penalty is payable to the county board of supervisors or municipal governing authority within 30 days of any necessary special election called to fill the vacancy, to defray election costs.

Penalty is enforceable as a fine in any court of competent jurisdiction and shall be recorded in the minutes of the board of supervisors or municipal governing authority.

Applies to vacancies in county offices, county district offices, and municipal elective offices with unexpired terms exceeding six months.

Takes effect July 1, 2020.
