Law enforcement officers must obtain written consent before conducting voluntary searches of persons not under arrest, their effects, or vehicles.

Officers must inform the person that the search is voluntary, they have the right to refuse, and they may withdraw consent at any time before obtaining signed consent.

Consent forms must include the notification factors, individual's name, date and time of stop, vehicle information if applicable, and names of all officers conducting the search.

Exemptions apply to searches with legal basis under Section 99-3-7, searches incident to lawful arrest, and searches in correctional facilities, custody facilities, or by probation/parole officers under consent conditions.

The act takes effect July 1, 2020.
