Senate Bill 2192 Summary

• Creates the "Jessica Marie Lofton Act" establishing a new crime for selling, transferring, marketing, or giving away human or synthetic urine intended for use in defrauding drug or alcohol screening tests.

• Prohibits possession of adulterants (such as bleach, nitrite, chromium, and hydrochloric acid) with intent to adulterate urine samples or other bodily fluid samples to defeat drug or alcohol screening tests.

• Prohibits advertising or attempting to defeat drug or alcohol screening tests through urine substitution, sample spiking, or use of related devices or measures.

• Creates a rebuttable presumption of fraudulent intent if heating elements or instructions for thwarting drug screening tests accompany the sale or distribution of human or synthetic urine.

• Establishes violation as a misdemeanor punishable by a fine of $1,000, imprisonment for six months, or both; effective July 1, 2020.
