MS SB2207

Adds new penalty for adults who flee or elude law enforcement while carrying passengers age 15 or younger: up to $5,000 fine or up to 5 years in Mississippi Department of Corrections custody, or both.

Maintains existing penalties for basic fleeing/eluding (misdemeanor up to $1,000 fine or 6 months jail), reckless fleeing (felony up to $5,000 fine or 5 years), serious bodily injury (3-20 years), and death (5-40 years).

Preserves existing legal defenses: officer not in uniform or vehicle not clearly marked as law enforcement, or driver proceeding safely to a well-lit public place before stopping.

Effective July 1, 2020.
