MS SB2240

Creates the "Mississippi Fairness Act" requiring public schools, higher education institutions, and NCAA/NAIA/NJCCA members to designate athletic teams by biological sex as "males/men/boys," "females/women/girls," or "coed/mixed."

Prohibits female-designated athletic teams from being open to students of male sex and allows students to establish sex through physician statement based on reproductive anatomy, testosterone levels, and genetic makeup.

Protects schools from complaints or adverse action by government entities, licensing organizations, or athletic associations for maintaining separate female athletic teams.

Creates private causes of action allowing students to sue for loss of athletic opportunities, retaliation, bodily privacy violations, and other harms, with a two-year statute of limitations and recovery of damages plus attorney's fees.

Effective July 1, 2020.
