Establishes new penalties for first and second simple possession offenses of controlled substances (other than small amounts of marijuana/synthetic cannabinoids), making them misdemeanors punishable by up to 6 months imprisonment for first offense and up to 1 year for second offense.

Creates enhanced penalties for third and subsequent simple possession offenses, with sentences varying by drug schedule and quantity, ranging from misdemeanors to felonies with imprisonment up to 30 years.

Modifies Section 41-29-147 to apply enhanced penalties (up to double the standard sentence and fine) only after a fourth or subsequent offense, instead of a second offense.

Maintains separate, reduced penalties for possession of 30 grams or less of marijuana or 10 grams or less of synthetic cannabinoids, with fines of $100-$250 for first offense and escalating penalties for subsequent convictions within 2 years.

Effective date: July 1, 2020.
