Permits nonadjudication of a first DUI offense for commercial driver's license holders who were not operating a commercial vehicle at the time of the offense.

Clarifies that out-of-state DUI convictions from other states, U.S. territories, or federally recognized Native American tribes count toward penalty enhancement for fourth and subsequent DUI violations without regard to time period.

Modifies expunction eligibility language to clarify that first-time DUI offenders are eligible only if they were not driving a vehicle requiring a commercial driver's license at the time of the offense.

Updates nonadjudication eligibility requirements using clarified language regarding commercial vehicle operation at the time of the offense.
