MS SB2638

Adds new subsection (5) establishing enhanced penalties when an adult flees or eludes police while carrying passengers age 15 or younger: up to $1,000 fine and/or up to one year in county jail.

Adds new subsection (6) establishing enhanced penalties for reckless fleeing with minor passengers: 3 to 5 years in Mississippi Department of Corrections (felony level).

Maintains existing penalties for basic fleeing/eluding (up to $1,000 fine and/or 6 months jail) and aggravated fleeing with reckless endangerment (felony with up to $5,000 fine and/or 5 years imprisonment).

Preserves existing sentencing requirements for fleeing resulting in serious bodily injury (3-20 years) or death (5-40 years).

Effective date: July 1, 2020.
