Secretary of State is authorized to enter into a memorandum of understanding to compare the Statewide Elections Management System with federal and state agencies and county records to ensure non-United States citizens are not registered to vote.

Registered voters flagged as potentially non-citizens must provide proof of citizenship within 30 days, which includes birth certificate, U.S. passport, naturalization documentation, or documents established under the Immigration Reform and Control Act of 1986.

Registrars shall purge voters from the system if they fail to provide proof of citizenship within the 30-day timeframe.

Voters unable to provide required documentation may appeal to the county board of election commissioners, which shall conduct a hearing and determine citizenship status.

All citizenship documentation and relevant agency records shall remain confidential and unavailable for public inspection; Secretary of State shall adopt rules and regulations for implementation; effective July 1, 2020.
