Senate Bill 3055 - Mississippi ICU Infrastructure Act

• Transfers $10,000,000 from the Budget Contingency Fund to establish an "ICU Infrastructure Fund" to provide grants to hospitals for COVID-19 pandemic response, including construction of intensive care units, isolation rooms, negative pressure rooms, and related medical equipment and HVAC alterations.

• Requires the Mississippi Department of Health to promulgate rules governing the program and make expenditures by October 30, 2020, with recipients certifying the need for these facilities and their ability to staff them adequately.

• Caps individual hospital awards at 25% of program funds and requires a minimum of 20% of funds to be allocated to Level III and Level IV trauma centers; allows the Department of Health to retain up to $50,000 for administration.

• Exempts ICU and isolation room construction funded under this program from the Healthcare Certificate of Need Law review process.

• Requires weekly status reports to legislative leadership through October 30, 2020, and mandates compliance with federal Coronavirus Relief Fund guidelines with audit provisions and repayment requirements for any improperly expended funds.
