HB 1013 Summary

• Creates the Mississippi Medicaid Commission as a seven-member board (three appointed by Governor, four by Lieutenant Governor with Senate confirmation) to replace and assume all powers and duties of the Division of Medicaid effective July 1, 2021.

• Commission members must have knowledge of Medicaid matters, cannot be healthcare providers or elected officials, serve staggered six-year terms, and are limited to two consecutive terms; members receive per diem and travel reimbursement.

• Executive director appointed by the commission (rather than Governor) must meet professional qualifications in healthcare administration and serves at the pleasure of the commission; current executive director exempted from this change until vacancy or January 1, 2024.

• Transfers all Division of Medicaid records, property, contractual obligations, unexpended appropriations, and employees to the new commission; establishes Medical Care Advisory Committee, Drug Use Review Board, and Pharmacy and Therapeutics Committee to advise the commission.

• Makes conforming changes throughout Mississippi Code to replace references to "Division of Medicaid" with "Mississippi Medicaid Commission" and adjusts administrative reporting structure from Governor's Office to independent commission governance.
