HB 1140 Summary

• Amends murder law to make unlawful distribution of controlled substances (Schedules I-V) first-degree murder when the substance is the proximate cause of death, for persons 18 years or older.

• Provides exception to first-degree murder charge if person in good faith seeks medical assistance for overdose victim, transports them to medical facility, or remains present to aid someone experiencing overdose.

• Brings forward existing controlled substances law penalties for distribution, possession, trafficking, and aggravated trafficking across all drug schedules.

• Adds new requirements for confidential informants: must be 21+ years old, notified of attorney rights 24 hours before agreement, all deals must be in writing, and informants may make only one transaction with each individual.

• Effective July 1, 2021.
