House Bill 1305 Summary

• Repeals the Mississippi Health Care Certificate of Need Law of 1979 (Sections 41-7-171 through 41-7-209), eliminating the requirement for certificates of need for health care facility projects.

• Amends 23 sections of the Mississippi Code to remove references to certificate of need requirements and conforming language related to the repealed law across hospital licensing, home health agencies, ambulatory surgical facilities, birthing centers, and other health care facilities.

• Removes certificate of need prerequisites from critical access hospital designations, hospital bed relicensing, and health care industry zone certifications.

• Maintains existing state licensing and regulatory authority for health care facilities through the State Department of Health while eliminating the separate certificate of need review process.

• Takes effect July 1, 2021.
