House Bill 1328 Summary

• Creates the Mississippi Warrants Task Force chaired by the Commissioner of the Department of Public Safety to study warrant issuance procedures, execution practices, and resulting injuries throughout the state.

• Task force composed of nine members including representatives from law enforcement agencies, prosecutors, public defenders, and appointed members from the Speaker of the House and Lieutenant Governor.

• Requires task force to study how warrants are issued, identify all entities authorized to issue warrants, document warrant circumstances, and create standards for issuing and executing warrants including knock and announce procedures.

• Task force must submit recommendations regarding knock and announce warrant procedures to the Speaker of the House and Lieutenant Governor by October 1, 2021.

• First meeting required no later than 15 days after July 1, 2021, with monthly meetings thereafter; all meetings open to the public with notice requirements per the Open Meetings Act; members receive per diem and expense reimbursement subject to task force authorization.
