Authorizes written gestational agreements where a woman agrees to become pregnant via assisted reproduction and relinquish all parental rights, with intended parents becoming the legal parents of the resulting child.

Requires intended parents to be married to each other, prohibits use of gestational mother's eggs, and mandates physician disclosure of success rates, health risks, and psychological effects before the agreement is executed.

Establishes court validation process requiring medical evidence that intended mother cannot safely carry pregnancy, home study of intended parents, and voluntary informed consent from all parties; court retains jurisdiction until child reaches 180 days old.

Allows any party to terminate the agreement before pregnancy occurs by written notice; upon birth, intended parents must file notice within 300 days and court must issue order confirming parental status and directing vital statistics to issue corrected birth certificate.

Declares unvalidated gestational agreements unenforceable but allows courts to hold unvalidated parties liable for child support; requires health care facilities performing assisted reproduction under gestational agreements to report annual statistics to State Board of Health.
