HB 354 Summary

• Authorizes municipal judges to order defendants to remedy violations of municipal real property ordinances within a reasonable time period set by the judge.

• Allows municipal judges to simultaneously authorize municipalities to remedy violations themselves using municipal employees or contractors if the defendant fails to comply within the prescribed time period.

• Permits municipalities to petition the court to assess documented cleanup costs to defendants as a judgment after a hearing, if the judge finds the defendant failed to remedy the violation and the municipality's costs were reasonable.

• Effective July 1, 2021.
