Allows Public Employees' Retirement System (PERS) retirees who are elected to the Mississippi Legislature to continue receiving their retirement allowance while serving, provided they have been retired at least 90 consecutive days before beginning legislative service

Legislators receiving retirement benefits while serving must choose one of two compensation options: receive 50% of regular session compensation while working no more than half the normal working days, or receive compensation not exceeding 25% of their average compensation with no time limitation

Persons who choose to receive retirement benefits while serving as legislators cannot be active members of PERS or the Supplemental Legislative Retirement Plan and will not earn additional creditable service during that period

Current legislators who meet age and/or service requirements may elect to begin receiving PERS retirement benefits while continuing to serve, without needing to withdraw from service first

Employers of legislators receiving retirement benefits while serving must pay the full employer contribution to PERS based on the compensation received
