Creates Section 25-11-126 allowing persons with 25+ years of creditable service and age 70+ who are receiving a Public Employees' Retirement System (PERS) allowance and elected to the Legislature after retirement to continue receiving retirement benefits while serving as a legislator.

Permits current legislators with 25+ years of service and age 70+ to elect to receive a PERS retirement allowance while serving in the Legislature without retiring first.

Eligible persons must choose between receiving 50% of legislative session compensation (if serving no more than half the normal working days per fiscal year) or compensation not exceeding 25% of their average compensation (with no time limit).

Persons receiving retirement allowances under this provision shall not be active members of PERS or the Supplemental Legislative Retirement Plan and shall not earn creditable service during their legislative service.

Amends Sections 25-11-105, 25-11-127, 25-11-305, 5-1-41, and 5-1-47 to conform with these provisions; effective July 1, 2021.
