House Bill 915 Summary

• Creates Section 25-11-126 allowing certain retired Public Employees' Retirement System (PERS) members elected to the Legislature to continue receiving retirement allowances while serving.

• Permits retired legislators to choose between receiving 50% of legislative compensation if serving no more than half the normal working days per fiscal year, or compensation capped at 25% of their average compensation with no time limitations.

• Requires a 90-day retirement period before election eligibility and prohibits those receiving retirement allowances while serving from accruing additional creditable service or active membership status in PERS or the Supplemental Legislative Retirement Plan.

• Amends Sections 25-11-105, 25-11-127, 25-11-305, 5-1-41, and 5-1-47 to implement conforming changes for legislative compensation and retirement system membership provisions.

• Effective July 1, 2021.
