House Bill 994 Summary

• Allows retired members of the Public Employees' Retirement System (PERS) to serve as members of the Legislature while continuing to receive retirement benefits, under the same conditions as those serving in elected county or municipal offices.

• Retired legislators may either waive all salary and receive only their retirement allowance plus office expenses, or receive up to 25% of their average compensation in addition to their retirement allowance.

• The house of the Legislature where the retired member serves must pay employer contributions to PERS on the full amount of regular compensation for the legislative position.

• Excludes retired members serving in the Legislature from becoming active members of the Supplemental Legislative Retirement Plan and from automatic membership in the regular retirement system.

• Clarifies that legislative compensation provisions do not apply when a retired PERS member serves in the Legislature under this exception.
