MS SB2101

Establishes the "Mississippi Pay Equity Act" prohibiting employers from paying employees of one gender less than employees of a different gender for comparable work.

Allows wage variations based on seniority systems, merit systems, production/quality metrics, geographic location, relevant education/training/experience, and necessary travel requirements.

Permits employees to file petitions in circuit court within 3 years of an alleged violation; if violated, employees receive 100% of unpaid wages plus attorney's fees and prejudgment interest, or 300% if willfully violated.

Prohibits employers from restricting employee discussions about wages, seeking prospective employees' salary history, and retaliating against employees who oppose pay discrimination, file complaints, or discuss wages.

Effective July 1, 2021.
