Amends Mississippi Code Section 63-11-30 to allow commercial driver's license (CDL) holders to be eligible for nonadjudication of a first DUI offense if they were not operating a commercial vehicle at the time of the offense.

Currently, CDL holders are ineligible for nonadjudication of first DUI offenses; this bill creates an exception for those driving non-commercial vehicles.

The nonadjudication option still requires the offender to complete alcohol safety education, pay fines and penalties, and comply with ignition-interlock device requirements as applicable.

Makes the same eligibility change for expunction of first DUI convictions, allowing CDL holders who were not operating commercial vehicles to petition for record expungement five years after completing their sentence.

Effective date: July 1, 2021.
